Estate of Christian Eyman Pennsylvania Orphans Court, Lancaster County Miscellaneous Books, 1833-1836, Page 257 & 258 (Order to seven men) November 17, 1834: Christian Eyman decd, On the Petition of John Eyman, Christian Eyman, Jacob Eyman, David Eyman, and Abraham Eyman sons of Christian Eyman deceased above the age of twenty one years, Jacob Harnish and Catharine his Wife (late Catharine Eyman) Adam Brenneman and Nancy his Wife (late Nancy Eyman) Henry Forrer and Magdalena his Wife (late Magdalena Eyman). Respectively represents that the said Christian Eyman died intestate on or about the 6th day of September 1834 leaving issue eight children to wit: John, Christian, Jacob, David, Abraham, Catharine who intermarried with Jacob Harmsh, Nancy who intermarried With Adam Brenneman, Magdalena, who intermarried with Henry Forrer, and seized in his DEMESNE(?), as of fee of and in the following described real Estate consisting of a MESSUAGE(?) tenement and plantation or tract of land situate lying and being in Conestoga township in the County of Lancaster aforesaid; adjoining lands of Jacob Fehl, Tobias B Stehman, Martin KENDIG(?), John Miller, and the Conestogoa Navigation containing seventy eight acres, be the same more or less. No Petition or Valuation of the said Estate having been had, the petitioners pray the Court, to order and appoint Henry Shenk, Tobias Stehman, Jacob Fehl, Christian Mylin, Abraham Hoss, John Hoober, and John Shenk chosen by the petitioners for that purpose to make partition or Valuation of the said premises seeing to the acts of Assembly in such case made and provided, and make report of their proceedings herein to the next Orphans Court after they shall have so parted or Valued the same. And they will pray ?. It is ordered by the Court that the said seven Men do View the said premises, and make partition thereof between the children of said deceased; if the same can be done without prejudice to and spoiling of the whole. But, if the find the same cannot be divided that they then inquire and report whether the said premises will conveniently accommodate more than one of the said heirs and legal representatives without prejudice to and spoiling of the Whole: and if they so find that they ascertain, and report, how many the same will as aforesaid accommodate, describing each purpart by meter and bounds and returning a just Valuation and appraisement thereof. But, in Case partition cannot be made between all the heirs and legal representatives aforesaid; nor the said premises accomodate more then one of the said heirs and legal representatives that they then Value and appraise the whole premises, agreeably to Law, that legal notice of the time and place of holding such inquisition, be given to all the parties interested, or their legal Representatives, that they may be present, if they think PROPER(?); and that report of the said proceeding be made to the next Orphan's Court to be held at Lancaster the Monday in next. Miscellaneous Books, 1833-1836, Page 284 (Repeat 7 Men Conf'd) December 3, 1834: Christian Eyman decd. Pursuant to an order of this Court of the 17th day of November 1834, directing Henry Shenk, Tobias Stehman, Jacob Fehl, Christian Mylin, Abraham Hoss, John Hoober, and John Shenk, seven men indifferently chosen by the Representatives of Christian Eyman deceased, to view ? the real Estate of said deceased, said Seven Men now report on the Words following viz: Inquisition taken the 22nd day of November on the Year of our Lord One thousand eight hundred and thirty four Pursuant to the annexed order of the Orphas Court of said County on the premises situate in the township of Conastogoe Consisting of seventy eight acres of Land adjoining the lands of Jacob Fehl, Tobias Stehman Martin Kending, now deceased and others. Before and by Henry Shenk, Tobias Stehman, Jacob Fehl, Christian Mylin, Abraham Hess, John Huber, and John Shenkwho did severally to into and upon the said premises, and are of Opinion and do find that the said premises cannot be parted and divided to and among the said children and legal representatives of said Christian Eyman deceased without prejudice to and spoiling of he whole, and the Inquest aforesaid do further find that the said premises with the appurtenances will not conveniently accomodate more than One of the said children of said Christian Eyman deceased without prejudice to and spoiling of the whole. And therefore do Value and Appraise the same at and for the sum of Ninety three Dollars per Acre for each and every Acre thereof amounting in the Whole to the sum of [BLANK] Which we submit as a reasonable Valuation thereof. Witness their hands and Seals the day and Year aforsaid. Which Inquisition being read was Confirmed by the Court. Miscellaneous Books, 1833-1836, Page 303 (Heirs Remaned Bond Sale Ordered) December 18, 1834: Christian Eyman, decd. In the Matter of the Valuation of the real Estate of Christian Eyman deceased Confirmed by this Court on the third day of December 1834, Now December 18th 1834. The heirs and legal representatives of said deceased in Writing (see filed) refuse to take the Real estate or any part thereof at the Valuation or appraisement made thereof and request the Court to Issue an order to Jacob Harnish and Jacob Eyman administrators of said Christian Eyman deceased to sell the said Real Estate at public VONDUE(?). Whereupon it is ordered by the Court that Jacob Harnish and Jacob Eyman administrators of the said Christian Eyman deceased do expose to public Sale the real Estate of said deceased not accepted by the heirs and legal representatives of the said deceased, at the Valuation made thereof by seven Men in pursuance of and order of this Cour of the 17th day of November 1834 and the Confirmation thereof by this Court on the third day of December 1834 Consisting of and in a Mossuage tenement and Plantation and had of land, situate lying and being in Conestogoe township in the County of Lancaster aforesaid, adjoining lands of Jacob Fehl, Tobias B. Stehman, Martin Kending, John Miller and the Conestoga Navigation containing Seventy eight Acres be the same more or less with the appurtenances; at the public house of Christian KOLERER(?) in Conestoga township on Saturday the 20th day of December 1834, Terms, Cash on first day of April 1835. That due and legal notice be given of the time and place of Sale, and that report of said proceedings be made to this Court on the third Monday in January 1835. Jacob Harnish bound in $14,500.00 To the Commonweath of Pennsylvania Jacobe Eyman bound in $14,500.00 for the use of all persons interested in the Henry Shenk bound in $14,500.00 Estate of the said, deceased. Tobias Stehman bound in $14,500.00 Miscellaneous Books, 1833-1836, Page 310 (Sale Confirmed) January 19, 1835: Christian Eyman, decd, Pursuant to an order of the Court of the 18th day of December Anno Domini 1834 directing Jacob Harnish and Jacob Eyman administrators of Christian Eyman deceased to expose to public Sale the of said deceased not accepted by the heirs and legal representatives of the said deceased, at the Valuation made thereof by seven Men in pursuance of and orderof this Court of the 17th day of November 1834 and the Confirmation thereof by this Court on the 3rd day of December 1834, consisting of and in a Mossuage tenement and plantation and tract of land situate lying and being in Conestoga township in the County of Lancaster adjoining lands of Jacob Fehl Tobias B. Stehman Martin Kendig John Miller and Conestoga Navigation, containing Seventy eight acres of the same more or less at the public house of Christian Rohrer in Conestoga township on Saturday the 20th day of December 1834. Term Cash on the first day of April 1835. Said Administrators do now report, That pursuant to the written order of Sale they did at the time and place within mentioned, after having given due public timely and legal notice of the time and place of Sale, expose the said premises within mentioned to public Vendue or outery, and the said premises were publicly struck off to John Warfel at and for the sum of Ninety dollars per Acre, Containing Seventy Nine Acres and twenty eight PERCHEES(?) neat Measure, Amounting in the whole to the sum of Seven thousan One hundred and twenty five dollars, and seventy five cents he being the highest and best bidder and that being the highest and best price bidden at the sale held for the same, All of which the Court are respectively requested to confirm. Which report being read the Court Confirm the Sale and the premises sold to the JOhn Warfel to him his heirs and assigns in fee as fully as the said Intestate had and held in the same immediately before and at the Time of his death; Subject and liable to the payment of the purchase money agreeable to the Terms prescribed by the Court in their said order of Sale. Miscellaneous Books, 1833-1836, Page 373 (Admin account) June 15th, 1835: Christian Eyman decd Jacob Harnish and Jacob Eyman administrators of Christian Eyman late of Conestoga township in the County of Lancaster, farmer, died having state and filed on the resters office at Lancaster the Admin account on the estate of he said decd, and legal notice thereof being given by the said register a copy of the same is now produced to the Court for confirmation, whereby it appears that the said account was duly passed by the said register, and that there remains in the hands of the said Accountants a ballance of $12,385.17 1/4 The Court on due examination thereof and advisement thereon approve of and confirm the same and direct that ballance to be paid and distributed agreeably to Law.
